Our Promise To You

We do not sell, rent or trade any personally identifiable information ("PII") you provide when using The Rochester Democrat. No PII information from this site is provided to any political candidate by either us or our owner organization.

Information We Collect

This website and related services ("The Rochester Democrat" or "Site" or “TRD”wink is owned by the Democratic Party Olmsted County DFL, Rochester, MN ("we" or "us"). We do not collect any PII about our users ("you") (such as your name or email address) when you use The Rochester Democrat unless you specifically decide to provide such information in order to enhance your user experience.

If you choose to provide an email address as part of personalizing The Rochester Democrat, we will only send an email to you to confirm online donations, or to confirm online purchases or to confirm you registration should you choose to register unless you specifically request an email response to a customer service inquiry or contact is required in order to protect someone's safety or to enforce our obligations to you. You are not required to provide an email address to personalize The Rochester Democrat.

We do collect anonymous or non-PII about you in connection with your use of the Site. For example, each time you come to The Rochester Democrat, we collect the limited information that your browser makes available whenever you visit any website: including (a) your Internet Protocol (IP) address, (b) your domain (e.g., whether you logged on from compaq.com or whitehouse.gov, for example), (c) the address of the last URL you visited prior to clicking through to the Site (d) your browser and platform type (e.g., a Netscape browser on a Macintosh platform), (e) your browser language, and (f) the data in any undeleted cookies that your browser previously accepted from us.

The Rochester Democrat is a division the Democratic Party Olmsted County DFL, Rochester, MN, Internet privacy is an issue that we take very seriously. We provide this Privacy Policy so that our users will know what personally identifiable information is and is not being collected about you through the Site, how that information is and is not being used, and with whom it is and is not being shared.

Also, although we and our affiliates own or operate other websites, such websites are not governed by this Privacy Policy.

Change of Ownership

As of January 11, 2006, The Rochester Democrat has become a wholly-owned subsidiary of Democratic Party Olmsted County DFL, Rochester, MN, and, thus, they now control our privacy practices. They are currently reviewing The Rochester Democrat’s privacy practices and while the review is in progress the policies will remain as stated here. This means that we expect that this Privacy Policy will remain in place after we become their property and that they will treat users' personal information with the same respect, and subject to the same constraints, as apply under this policy. If in the future the Democratic Party Olmsted County DFL decides to revise The Rochester Democrat’s privacy practices, those changes will be announced in the manner required by this policy.

Welcome to The Rochester Democrat website (the "Site"). When using the Site and/or any related services (including The Rochester Democrat email service) (the Site and related services are hereinafter referred to as the "The Rochester Democrat Service"), you agree to the terms and conditions set forth herein (the "Terms of Service"). If you do not agree to these Terms of Service, you are not authorized either to use The Rochester Democrat Service (including any portion thereof) or to sign-up for Site membership.

General Terms of Service

You are permitted to use The Rochester Democrat Service for personal, educational, archival, non-commercial purposes only.

• impersonate any person or entity, including, but not limited to, The Rochester Democrat personnel, or falsely state or otherwise misrepresent your affiliation with a person or entity, or express or imply that any statements you make are endorsed by us, absent our prior written consent;


• forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service;


• upload, post, email or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);


• upload, post, email or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;


• upload, post, email or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation, except in those areas that are designated for such purpose;


• upload, post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, harm, destroy or limit the functionality of any computer software or hardware or telecommunications equipment, or to surreptitiously monitor the recipient's computer use or online activities without such recipient's consent;


• "frame" or "mirror" any part of The Rochester Democrat Service without our prior written authorization;


•interfere with or disrupt The Rochester Democrat Service or servers or networks connected to The Rochester Democrat Service, or disobey any requirements, procedures, policies or regulations of networks connected to The Rochester Democrat Service;


• intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including, without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law;


• use any robot, spider, site search/retrieval application or other manual or automatic device or process to retrieve, index, "data mine" or in any way reproduce or circumvent the navigational structure of presentation of The Rochester Democrat Service or its contents;


•"stalk" or otherwise harass another member or user of the The Rochester Democrat Service; or harvest, collect or store personal data about other users or members; or


• engage in illegal, fraudulent or misleading activities.

You acknowledge that all Content, whether publicly posted or privately transmitted, is the sole responsibility of the person from which such Content originated. This means that you are entirely responsible for all Content that you post, email or otherwise transmit via The Rochester Democrat Service. The Rochester Democrat does not control all of the Content posted, emailed or transmitted via The Rochester Democrat Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. Although The Rochester Democrat reserves the right to remove without notice any posting for any reason, we have no obligation to delete content that you may find objectionable or offensive. By uploading materials to any bulletin board or submitting any materials to us, you automatically grant (or warrant that the owner of such materials has expressly granted) to us and our designees a perpetual, royalty-free, irrevocable, sublicenseable, transferable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from and distribute such materials or incorporate such materials into any form, medium, or technology now known or later developed throughout the universe. In addition, you warrant that all so-called "moral rights" in those materials have been waived. We reserve the right (but do not have an obligation) to monitor The Rochester Democrat Service for adherence to these or other rules that may be published by us from time to time. We may revoke your registration privileges and/or take any other appropriate measures to enforce these rules upon learning of violations or suspected violations. Further, The Rochester Democrat, in its sole discretion, may terminate your membership and registration or restrict or block your ability to access all or any portion of The Rochester Democrat Service for any or no reason.

Additional Email Service Obligations

In addition to the terms and conditions set forth in this Terms of Service that are applicable to The Rochester Democrat Service (including The Rochester Democrat email service), the terms and conditions set forth in this section of the Terms of Service are specifically applicable to The Rochester Democrat email service.

The amount of email storage space per member is limited. Some email messages may not be processed due to space constraints or outbound message limitations. You agree that The Rochester Democrat is responsible or liable for the deletion, failure to process, or failure to store messages or other information.

Unless you have email forwarding set up for your The Rochester Democrat email account, we may terminate your account and delete all messages, files and other correspondence in your account without prior notice to you if you have not logged into or accessed your account for ninety consecutive days.

In using The Rochester Democrat email service, you agree to comply with any requirements, procedures, policies or regulations of networks connected to The Rochester Democrat email service, and to comply with all applicable laws and regulations regarding email usage.

The Rochester Democrat reserves the right to immediately suspend, terminate, access and investigate any email account which it believes, in its sole discretion, is transmitting or is otherwise connected with either (a) the distribution of unsolicited commercial email messages, "spam," or any harassing or offensive email messages, or (b) any fraudulent, misleading or illegal activities. In addition, because of the difficulty associated with quantifying damages, if actual damages cannot be reasonably calculated, then you agree to pay The Rochester Democrat liquidated damages of $5 for each piece of unsolicited commercial email transmitted from or otherwise connected with your account or the maximum liquidated damages permitted under law, whichever is greater; otherwise you agree to pay The Rochester Democrat's actual damages, to the extent such actual damages can be reasonably calculated.


Submissions

YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE ROCHESTER DEMOCRAT SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF THE ROCHESTER DEMOCRAT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE ROCHESTER DEMOCRAT SERVICE (INCLUDING ANY ASPECT THEREOF); (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE ROCHESTER DEMOCRAT SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE ROCHESTER DEMOCRAT SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE THE ROCHESTER DEMOCRAT SERVICE. IN NO EVENT SHALL THE ROCHESTER DEMOCRAT'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE), OR OTHERWISE EXCEED THE AMOUNT PAID BY YOU TO THE ROCHESTER DEMOCRAT, IF ANY, FOR ACCESSING THE ROCHESTER DEMOCRAT SERVICE.
YOU ACKNOWLEDGE AND AGREE THAT, REGARDLESS OF ANY STATUTE OR LAW TO THE CONTRARY, ANY CLAIM OR CAUSE OF ACTION YOU MAY HAVE ARISING OUT OF, OR RELATING TO, YOUR USE OF THE ROCHESTER DEMOCRAT SERVICE MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION ARISES, OR FOREVER BE BARRED.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.


Indemnification

YOU AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS THE ROCHESTER DEMOCRAT AND ITS PARENTS, AFFILIATES AND SUBSIDIARY COMPANIES, SUPPLIERS, ADVERTISERS AND PARTNERS, AND EACH OF THEIR OFFICERS, DIRECTORS, EMPLOYEES, CONSULTANTS AND AGENTS, FROM ANY AND ALL THIRD PARTY CLAIMS, LIABILITY, DAMAGES AND/OR COSTS (INCLUDING, BUT NOT LIMITED TO, ATTORNEYS FEES) ARISING FROM YOUR USE OF THE ROCHESTER DEMOCRAT SERVICE, YOUR VIOLATION OF THE TERMS OF SERVICE OR YOUR INFRINGEMENT, OR INFRINGEMENT BY ANY OTHER USER OF YOUR ACCOUNT, OF ANY INTELLECTUAL PROPERTY OR OTHER RIGHT OF ANY PERSON OR ENTITY.

Termination and Modification

You agree that The Rochester Democrat, in its sole discretion, may terminate your password, account (or any part thereof) or use of The Rochester Democrat Service, and remove and discard any Content within The Rochester Democrat Service, for any reason, including, without limitation, for lack of use or if The Rochester Democrat believes that you have violated or acted inconsistently with the letter or spirit of the Terms of Service. Further, you agree that The Rochester Democrat shall not be liable to you or any third-party for any termination of your access to The Rochester Democrat Service. We reserve the right, at our discretion, to change, add, or remove portions of these Terms of Service at any time. Please check back at this webpage periodically for changes (you can determine if this Terms of Service has been modified since your last visit by referring to the "Effective Date" at the bottom of this webpage). Your continued use of The Rochester Democrat Service following the posting of changes to these terms (including our Code of Conduct) will mean you accept those changes.


Governing Law and Other Miscellaneous Terms

Unless expressly stated to the contrary elsewhere, all legal issues arising from or related to the use of The Rochester Democrat Service shall construed in accordance with, and all questions with respect thereto shall be determined by, the laws of the state of Minnesota applicable to contracts entered into and wholly to be performed within such state. Any controversy or claim arising out of or relating to these Terms of Service or your use of The Rochester Democrat Service shall be settled by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association or JAMS. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Rochester, MN, and judgment on the arbitration award may be entered into in any state or federal court in Minnesota having subject matter jurisdiction thereof. Any party seeking temporary or preliminary injunctive relief may do so in any state court in Minnesota or federal court in Minnesota having subject matter jurisdiction thereof. You hereby waive any personal jurisdiction, venue and inconvenient forum objections to such state or federal court in Minnesota. If any provision of these terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between you and us relating to the subject matter herein and shall not be modified by you except in writing, signed by the parties. The Terms of Service will inure to the benefit of our successors, assigns and licensees.

We respect the intellectual property of others, and we ask our users to do the same. We may, in appropriate circumstances and at its discretion, terminate the accounts of users who infringe the intellectual property rights of others.
